- Prior Authorization Requirements For Providers Prescribing Buprenorphine-Containing Products

State law or statute prohibits or limits the use of prior authorization for buprenorphine containing products by either the state Medicaid plan or private insurance companies.
Prior authorization is prohibited for at least one medication in each therapeutic class of medication assisted treatment (MAT) medications for opioid use disorder (OUD) and for MAT for OUD for pregnant women (medications + counseling). MAT includes counseling. Maine Rev. Stat. Ann. tit. 24-A, §4304,-A(2)

Diagnostic ability is not outlined in statute, but LPCs are prohibited from diagnosing or treating mental health disorders in administrative code.
Licensed professional counselors may assess personal, interpersonal and group characteristics; consult with a client to understand and solve a current or potential problem; counsel individuals, families or groups; and refer a counselee to other specialists. Me. Rev. Stat. Ann. tit. 32 §13858
LPCs are explicitly prohibited from diagnosing patients. LPCs practice the principles and procedures of counseling to assist those served in achieving more effective personal, emotional, social, educational and vocational development and adjustment. Me. Code of Regs. §02.514 Chapter 2.1
