2015 Year End Summary of Equal Pay Legislation

The 2015 legislative session saw 76 equal pay related bills introduced in 33 states. Eight legislatures passed laws, including provisions broadening the application of current laws to additional workplaces, prohibiting retaliation for filing a complaint or assisting another in filing a complaint, and allowing employees to discuss wages without penalty or adverse action. Bills were passed in California, Connecticut, Delaware, Illinois, New York, North Dakota, Oklahoma and Oregon.

Summary: Establishes the Equal Pay Remedies and Enforcement Act; expresses certain legislative findings regarding wage differentials between males, females, minorities, and non-minorities; creates the Equal Pay Commission to study wage disparities and report its findings and recommendations to the Speaker of the House of Representatives for transmission to the governor and the Legislature.

Authorizes requiring approval and certification of the program. Permits a requirement for a nondiscrimination report from certain employers. Requires a definition of employee. Summary: Amends existing law requiring equal pay for equal work irrespective of sex; increases the penalty for a violation from double unpaid wages to triple unpaid wages plus reasonable attorney fees; prohibits employers from punishing employees for sharing salary information with coworkers; prohibits unequal provision of benefits; includes health insurance, retirement benefits, life insurance, disability insurance, work breaks, paid vacation and holidays, and sick leave.
