2011 Minimum Wage Legislation

Minimum wage bills were introduced in 29 states during the 2011 legislation session, with laws enacted in six states.  Of those states, the new laws in Indiana and New Hampshire are of particular note. Indiana passed a law prohibiting local units of government from enacting minimum wages that exceed the state or federal minimum wage.  New Hampshire repealed their state minimum wage, which was $7.25 an hour, becoming the first state to do so.  Employees in the state are still covered by the federal minimum wage, also set at $7.25 an hour.

Summary of 2011 Enacted Bills
  • California passed a law providing for a cause of action for damages for failure to pay the state or federal minimum wage.
  • Indiana passed a law prohibiting local units of government from enacting a minimum wage law that exceeds the state or federal minimum wage.
  • New Hampshire repealed their state minimum wage.
  • Oregon passed two laws on minimum wage.  The first raised the amount exempt from garnishment; the second exempted volunteer golf course marshals from minimum wage provisions.
  • South Dakota revised the minimum wage law for seasonal camp, amusement park or religious conference center employees.
  • Virginia passed a law regarding eligibility requirements for enterprise zone grants for jobs paying a percentage of the federal minimum wage, including benefits.
