2011 Family Leave Legislation

Twenty states introduced bills related to family leave during the 2011 legislative session.  Four states passed laws.  Of particular note, Washington again delayed implementation of their paid family leave law, this time until 2015.  The law was orgininally passed to take effect in 2009 but implementation of the program has twice been delayed.  California and New Jersey remain the only two states with paid family leave laws.

Summary of Enacted Legislation

California enacted a law requiring employers to maintain group health coverage for female employees while they are on maternity leave.

North Dakota passed a law increasing from 40 to 80 hours the amount of available leave a state employee may use for family leave.

Washington enacted a law delaying implementation of the state’s paid family leave program from 2012 to 2015.

Wisconsin passed a law prohibiting local units of government from requiring employers to grant paid or unpaid family leave.
