Abandoned or Unclaimed Property and Escheatment Statutes

Last updated: October 16, 2019

Property that is lost or forgotten will be considered abandoned or unclaimed. Unclaimed property can include savings or checking accounts, stocks, uncashed dividends or payroll checks, refunds, traveler's checks, trust distributions, unredeemed money orders, insurance payments or refunds and life insurance policies, annuities, certificates of deposit, customer overpayments, utility security deposits, mineral royalty payments, and contents of safe deposit boxes. When property is determined to be abandoned or unclaimed, the laws in the chart below allow states to hold the property until it is reclaimed by the rightful owner. Some states consider gift cards and certificates abandoned property and have specific provisions for unclaimed gift certificates. Information regarding abandoned or unclaimed gift cards and gift certificates can be found on the Gift Cards and Certificates Statutes and Legislation webpage.

PLEASE NOTE: The statutory chart should be used for general informational purposes and not as a legal reference. NCSL is unable to provide guidance to citizens or businesses regarding abandoned or unclaimed property laws and practices.
