Energy Efficiency Financing Legislative Update

Energy efficiency is a central component of US energy policy, promising to increase energy security,  reduce air emissions and lower energy bills. This update summarizes 2013 enacted and pending legislation related to energy efficiency financing, specifically bills pertaining to energy efficiency loan and grant programs, on-bill financing programs, property assessed clean energy (PACE) programs, energy efficiency tax credits, incentives, and rebates, and energy saving performance contracts.

Many states have energy efficiency or clean energy grant or loan programs to help support or subsidize energy efficiency initiatives. There are at least 41 pending bills in 15 states related to state energy efficiency loan and grant programs.

On-bill financing programs allow businesses or residences to pursue energy efficiency improvements that are repaid through surcharges on their utility bills. In many states, utilities need legal authorization to establish an on-bill loan or tariff program. There are at least six pending bills in three states related to on-bill financing.

Property Assessed Clean Energy (PACE) programs finance energy efficiency improvements to a property. The loans used to make these improvements are generally secured with a lien on the property. Conflict with Freddie Mae and Fannie Mac over the first lien status of PACE loans has slowed the programs’ progress, despite action by states to authorize them There are at least 10 pending bills in eight states related to PACE programs.
