‘Today States Achieved a Great Victory’
Chicago—NCSL President and Utah state Senator Curt Bramble said, “Today states achieved a great victory in the 6th U.S. Circuit Court of Appeals with the decision that the Federal Communications Commission (FCC) does not have the authority to pre-empt state laws in Tennessee and North Carolina regulating municipal broadband networks. The 6th Circuit's decision overturns a blatant attempt by the FCC to pre-empt the sovereign rights of states. NCSL, which filed an amicus brief on behalf of the Tennessee and North Carolina, has continued to favor efforts that seek to maximize the effectiveness of a flourishing state federal partnership, which is a stark contrast to the FCC’s regulatory proceedings. NCSL believes its efforts struck at the heart of the principles of federalism that our Founding Fathers envisioned.”
