Jan. 29, 2025: EO issued directing several agencies, including the Department of Education, to develop an "ending indoctrination strategy." The plans will evaluate where federal funds directly or indirectly subsidize "discriminatory equity ideology," which the order defines as instruction treating people as "members of preferred or disfavored groups, rather than as individuals." If the agency finds such instances, the plans will make recommendations where those funds could be rescinded "to the maximum extent consistent with applicable law."
The order reestablishes the 1776 Commission, originally formed at the end of Trump's first term, to promote "patriotic education" surrounding the 250th anniversary of American independence and defines the term "patriotic education."

Full Text: Letter
The Department of Education stated in a letter that the 2020 Title IX rule on sexual harassment is once again in effect after the courts vacated a similar rule finalized in 2024 to replace the 2020 rule. Notably, the 2020 rule contains provisions that outline how schools and universities must handle allegations of sexual assault and harassment, including giving accused students a written notice of allegations, the right to an advisor, and the right to submit, cross-examine and challenge evidence at a live or virtual hearing. Schools may choose between two standards of evidence when adjudicating complaints: the "preponderance of the evidence" standard or the "clear and convincing evidence" standard. The 2020 rule also expanded the definition of "sexual harassment" to include sexual assault, dating violence and stalking, among other provisions.
In a separate action, the department rescinded January 2024 guidance related to name, image and likeness activities under Title IX. The previous guidance was the first of its kind for NIL activities. It is unclear whether the department will issue new guidance or promulgate a rule. Under the previous guidance, any compensation a school provided for a student-athlete's NIL was to be considered as athletic financial assistance, which must be provided proportionally to male and female student-athletes.

Jan. 28, 2025: The Office of Management and Budget released a follow-up Q&A document to clarify that the pause is not intended to stop all funding, but instead is "expressly limited to programs, projects, and activities implicated by the President's Executive Orders, such as ending DEI, the green new deal, and funding nongovernmental organizations that undermine the national interest." The reversal followed a federal judge's temporary stay on the initial pause on Jan. 28, which would have continued until Feb. 3 to provide time for thorough deliberation on the matter.
Jan. 27, 2025: The Office of Management and Budget released a memorandum (M-25-13) to heads of executive departments and agencies providing further guidance.
any program not implicated by the executive orders above is not subject to the pause. Any program that provides benefits directly to individuals was not subject to the pause. And a list of the programs subject to the pause does not currently exist as they are still identifying how funds are being spent.
