Special Rules for Certain Benefits

States can provide TANF benefits to residents who are not yet U.S. citizens if they have not been ruled ineligible by the federal law. Most governors who have submitted plans have said that they intend to continue benefits to noncitizens who legally reside within their borders. So far, only Kentucky, Louisiana, Oklahoma and Wyoming plan to eliminate optional benefits to noncitizens.

States can also adopt special rules for poor families that move into their states. So far, five state plans have indicated an intention to do so: California, Florida, Maryland, New York and Wisconsin.
