Note:

NHTSA and the FHWA administer an incentive grant program, which was authorized under the Transportation Equity Act for the 21st Century (TEA 21), 23 U.S.C. Section 163, under which States can qualify for grant funds if they enact and enforce a conforming .08 BAC per se law. To conform, a law must meet the requirements of the Section 163 statute and the agencies' implementing regulations.
