Federal Update--Deputation of State & Local Law Enforcement Officers for Federal Airport Security Duties


Consolidated Appropriations Resolution, 2003

On February 20, 2003 H.J.RES.2 became Public Law No: 108-7 providing federal appropriations for the FY 2003 budget cycle for those agencies still operating under continuing resolutions. As a part of the Department of Transportation FY 2003 appropriations the Under Secretary of Transportation was granted the authority to deputize a State or local law enforcement officer to carry out Federal airport security duties.

Under "SEC. 44922" a State or local law enforcement officer so deputized would be treated as a Federal law enforcement officer for the purposes of carrying out Federal airport security duties. In order to deputize a State or local law enforcement officer the Undersecretary would enter into an agreement with the appropriate state or local law enforcement agency which would include provisions for reimbursement of costs incurred by the agency with regard to the deputized officer. In addition, the deputized officer will be treated as an "employee of the government" under the Federal Tort Claims Act.
