Overview

Computers and the internet continue to change the way we conduct business, govern and interact with one another. State and federal policymakers grapple with the issues of identity theft and the privacy of online information. Hear about the current state of digital information and examine what issues state lawmakers should be aware of.

Jim Halpert, a partner with DLA Piper, gave an overview on privacy issues, highlighting that there can be conflicts between the efforts to protect privacy and combat identity theft.

Senator Charleta Tavares discussed the legislation she sponsored to prohibit employers, employment agencies, personnel placement services, and labor organizations from requiring an applicant or employee to provide access to private electronic accounts.

House Assistant Minority Leader James Durkin discussed his concerns with legislation intended to prevent employers from accessing employees' social media accounts, as a solution in search of a problem.

Senator Ellen Roberts discussed her legislative efforts to amend Colorado's impersonation provisions, after a Colorado Supreme Court decision made it more difficult to prosecute identity theft crimes.

Senator Delores Kelley discussed her legislative efforts to enact identity theft forfeiture and restitution provisions in her state.
