On February 28, 2007, Senator Akaka (HI-D), along with Senators Sununu (NH-R), Leahy (VT-D) and Tester (MT-D), introduced the Security Enhancement Act of 2007 (S. 717), which would "repeal the Real ID Act and reinstitute the shared rulemaking and more reasonable guidelines established in the Intelligence Reform Act."

On February 15, 2007, Representative Tom Allen (ME-D) introduced H.R. 1117, which would return Real ID Act implementation to a negotiated rulemaking among federal and state officials.

On February 13, 2007, Senator Collins (ME-R) introduced S. 563, which would delay the implementation of the Real ID and would require the Department of Homeland Security "to take into account the concerns and challenges associated with states’ compliance" with the implementation of the Real ID.

Identification Security Enhancement Act of 2006 (S. 4117)
On December 8, 2006, Senator Akaka (D-HI) and John Sununu (R-NH) introduced the Identification Security Enhancement Act of 2006 (S. 4117), which would "repeal the Real ID Act and reinstitute the shared rulemaking and more reasonable guidelines established in the Intelligence Reform Act."

Real ID Act of 2005
On May 11, 2005, President Bush signed into law the “Emergency Supplemental Appropriation for Defense, the Global War on Terror, and Tsunami Relief, 2005” (H.R. 1268, P.L. 109-13), which included the “Real ID Act of 2005.” Title II of Real ID—“Improved Security for Driver’s License’ and Personal Identification Cards”—repeals the provisions of a December 2004 law (P.L. 108-458) that established a negotiated rule making process to create federal standards for driver’s licenses and instead directly imposes prescriptive federal driver’s license standards.

In December 2004, President George W. Bush signed into law the National Intelligence Reform Act of 2004 (P.L. 108-458). The legislation was in response to the recommendations made by the 9/11 commission to reform the U.S. Intelligence community and to implement other security measures to prevent future terrorist attacks against the U.S. Under section 7212 of the National Intelligence Reform Act of 2004, the U.S. Secretary of Transportation was required to establish a negotiated rule making process to establish minimum standards for state-issued driver's licenses (DL) and identification cards (ID). |
