Stopping Spam: Strategies for Effective Enforcement
Michael Goodman
Michael Goodman joined the Federal Trade Commission's Bureau of Consumer
Protection as a staff attorney in January 2000. In his time at the FTC,
Goodman has worked extensively on the Telemarketing Sales Rule, including
the creation of the National Do Not Call Registry. He co-authored the FTC's
study of the use of false claims in spam, and he is coordinating the FTC's
rulemaking efforts under the CAN-Spam Act. Goodman has also litigated a
variety of consumer protection cases in federal courts across the country,
including cases involving business opportunity fraud, telemarketing fraud,
and deceptive marketing of Internet access services. He has also trained
law enforcement groups nationwide regarding how to investigate fraud on
the Internet.
Representative Wayne Harper
Wayne Harper serves as Speaker Pro-Tempore of the Utah House of Representatives.
He is Chair of the House Revenue and Taxation Standing Committee and is
a member of the Capital Facilities and Administrative Services Appropriations
Subcommittee and the House Law Enforcement and Criminal Justice Committee.
He also serves on the Utah State Capitol Preservation Board and the Utah
State Historical Records Advisory Board. He also is a member of the Streamlined
Sales Tax Project's Implementing States Governing Board. Represen-tative
Harper works in business development and is currently the Director of Economic
Development for the City of West Jordan, Utah. Previously, he was Manager
of Information and Customer Service for the Utah State Tax Commission,
Archivist for the LDS Historical Department, and an Instructor at Salt
Lake Community College. His community affiliations include serving as a
board member of the West Jordan Area Chamber of Commerce, serving as legislative
vice-president of the PTA at school and council levels. He also works on
behalf of the Utah Alliance for Economic Development, the Conference of
Inter-Mountain Archivists, the Utah Redevelopment Association, the International
Economic Development Council, and the International Council of Shopping
Centers. He is a former member of the West Jordan City Council. Representative
Harper holds B.A. and M.S. degrees in history from Brigham Young University.
Senator Steve Kelley
Steve Kelley served in the Minnesota House from 1992 to 1996, was elected
to the Minnesota Senate in 1996, and won reelection to the Senate in November
2002. Special legislative concerns to Senator Kelley include property taxes,
education, telecommunications and technology. He serves as vice-chair of
the Telecommunications, Energy and Utilities Committee and serves on the
Education Committee; Higher Education Budget Division Committee; Tax Committee;
and Property Taxes Budget Division Committee. His commission work includes
the Information Technology Ad Hoc Committee, the Intergovernmental Information
Systems Advisory Council, the Minnesota Education Instructional Telecommunications
Council and the Telecommunications Services Study Working Group. Senator
Kelley received his B.A. from Williams College and J.D. from Columbia University.
Russell E. McGuire
Russell McGuire is an Assistant Attorney General/Prosecutor in the
Office of the Attorney General for Virginia, where he is assigned to the
Computer Crime Unit. He prosecutes cases involving spam, child pornography
and identity theft. Prior to joining the office he served as an Assistant
Professor of Criminal and Constitutional Law and is a former prosecutor
for the City of Richmond.
E-911: Federal Requirements and State Deployment
Frank Torres
Frank Torres is the Director of Consumer Affairs for the Microsoft
Corporation. Prior to joining Microsoft, he served as Legislative Counsel
in the Washington, D.C. consumer advocacy office of Consumers Union, the
publisher of Consumer Reports magazine. Torres is an expert on consumer
privacy issues. He has testified on numerous occasions before the United
States Congress on privacy legislation, as well as issues affecting banking
and finance, consumer credit and lending, the independence of financial
auditors, financial and Internet privacy, and proposed changes to bankruptcy
law. Torres was a member of the Federal Trade Commission Advisory Committee
on Online Access and Security. Torres received his doctor of jurisprudence
degree from George Washington University and his undergraduate degree Georgetown
University.
Genie Barton, Acting Associate Division Chief

Eugenie Barton is the Acting Associate Division Chief of the newly
reorganized Public Safety and Critical Infrastructure Division of the Wireless
Telecommunications Bureau. Her portfolio contains, among other issues,
the policies and implementation issues surrounding enhanced 911 (E911)
wireless services. Genie has been at the Commission for three years, first
in the Office of the General Counsel, and then in the Policy Division of
WTB. Before working as an attorney at the Commission, Genie held legal
positions in each of the three branches of the Federal Government. After
graduation from law school she served in the judicial branch as law clerk
to the Hon. Lawrence Silberman, on the Court of Appeals of the District
of Columbia Circuit. She then moved to the executive branch at the Department
of Commerce where she worked in the General Counsel's office on technology,
telecommunications, intellectual property and other legislation before
serving as Acting Senior Technology Advisor to the Secretary. She then
moved to the legislative branch where she served as Solicitor to the Board
of the Office of Compliance, a new, independent agency that oversaw the
application of 11 workplace related laws to the legislative branch. Genie
holds a number of degrees. In addition to her law degree from the National
College of Law at George Washington University, Genie holds an MA in English
from Princeton University, a BA/MA with highest honors from Oxford University,
and a BA from Sarah Lawrence College. Before attending law school, Genie
worked for six years at the Shakespeare Theatre, as their first dramaturge.
She is the mother of 8-year old triplets.
John Crabill, Regional Vice President
National Emergency Number Association; 9-1-1 Coordinator Montgomery

John has 30 years experience in 9-1-1. As the 9-1-1 Coordinator for
Montgomery County, for the past fifteen years, John has been involved in
a number of state, local and national initiatives to advance 9-1-1. For
the last eleven years he has served the Maryland Emergency Number Systems
Board as a Committee Chair for; Training and Certification, Wireless and
Legislative Committees. In that time he also held the Governor appointment
Board Member representing the Mid-Easter Chapter of the Association of
Public Safety Communications Officials International.
A recognized leader in his profession, John was elected to the National
Emergency Number Association national board in 2001.
Brian F. Fontes, Ph.D.

Dr. Brian Fontes, Vice President for Federal Relations for Cingular
Wireless, is responsible for Cingular's Washington, D.C. office and all
Federal relations. Prior to joining Cingular Wireless, Dr. Fontes served
as the Senior Vice President for Policy and Administration at the Cellular
Telecommunications & Internet Association (CTIA). Before joining CTIA,
Dr. Fontes served as Chief of Staff for the Federal Communications Commission
and as Senior Advisor to FCC Commissioner James H. Quello. In 1995, Dr.
Fontes was given the rank of Ambassador and served as head of the United
States Delegation to the International Telecommunication Union's (ITU)
World Radio Conference held in Geneva, Switzerland. He chaired the World
Radio Conference 2003 Industry Advisory Group. Dr. Fontes serves as Chairman
of the Communication Regulatory Agency for Bosnia and Herzegovina. Dr.
Fontes received a Ph.D. in Mass/Telecommunications from Michigan State
University. He currently serves on the Board of Directors of the Federal
Communications Bar Association Foundation, the E-911 Institute and Chairman
of the Advisory Board for the James H. and Mary B. Quello Center for Telecommunication
Management and Law.

Working to "make government make sense" has been Senator Debra Bowen's
aim ever since she was first elected to the Legislature in 1992. After
serving in the Assembly for six years, Senator Bowen was elected to the
California State Senate in November 1998. During her time in office, Senator
Bowen has focused her attention on opening government to the people, protecting
the environment, overhauling California's dysfunctional electricity market,
and protecting consumers. She sponsored landmark legislation to unlock
the Legislature's computer files, giving computer users instant access
to information about bills, committee analyses and legislators' voting
records via the Internet. She also authored the California Digital Signature
Act, and her "anti-spam" legislation in 1998 gives consumers and businesses
the ability to guard against unsolicited email. Senator Bowen has introduced
privacy legislation to safeguard against supermarket club card tracking,
stop secret monitoring of employee email and Internet use, and prevent
identity theft.
Senator Bowen has chaired the Senate Energy, Utilities & Communications
Committee since 1999 and also serves on the Agriculture & Water Resources,
Appropriations, Constitutional Amendments, Housing & Community Development,
Natural Resources & Wildlife, and Revenue & Taxation committees.
She graduated from Michigan State University and earned her law degree
form the University of Virginia.

As Director for EDS Security and Privacy Professional Services, Ms.
Hollis is responsible for the consulting, technical services, delivery
and support of security architecture, secure messaging, identity management,
public key infrastructure (PKI), wireless, biometrics and smart cards to
the ever-increasing EDS global client base. Prior to coming to EDS, Ms.
Hollis spent 15 years with the Department of Defense. She served as special
assistant to the Deputy, DOD PKI Program Office while building and implementing
the DISA Smart Card IPT and serving as the Federal Chair to the Electronic
Commerce Coalition Information Assurance Working Group. Ms. Hollis was
the Deputy Director for the Office of the Secretary of Defense Y2K Program
and prior to that, the Deputy Director for the Deputy Secretary of Defense
Electronic Processes Initiatives (EPIC) Task Force, which formulated the
federal government's approach to electronic buying and paying. Ms. Hollis
was one of the early program managers for the DOD Electronic Commerce/
Electronic Data Interchange (EC/EDI) program and was responsible for the
introduction of the Electronic Processing Nodes concept and the interface
with the commercial Value Added Networks (VANs). Ms. Hollis was recently
published in the 2002-2003 Who's Who of American Women. She is a
member of the Armed Forces Communications and Electronics Association Technical
Board and a founding member of the Federated Electronic Government Coalition.
During her service to the Department of Defense Ms. Hollis received a 1998
"Federal 100" Award and the Commanders Award for Outstanding Civilian Service.
Ms. Hollis is a graduate of the National War College with a Master of Science
Degree in National Security Strategy. Her undergraduate degree is in Political
Science from the University of Minnesota

Elected to the Minnesota Senate in 1996, Senator Kelley currently chairs
the Senate Education Committee and is vice-chair of the Senate Telecommunications,
Commerce and Utilities Committee. He is Vice Chair of the Higher Education
Budget Division. He has served on the Advisory Council on the Roles and
Responsibilities of Local Government, the Intergovernmental Information
Systems Advisory Council, the Task Force on Electronic Filing of Real Estate
Documents and the Telecommunications Services Study Working Group. From
1997-2000, Senator Kelley chaired the Senate's Ad Hoc Committee on Information
Technology. Senator Kelley currently serves as chair of NCSL's new Foundation

From 2001-2003, Senator Kelley chaired NCSL's standing committee that addressed

Michael Vatis is executive director of the Markle Foundation's Task
Force on National Security in the Information Age and an attorney with
Fried, Frank, Harris, Shriver and Jacobson. From 2001 to 2003, he served
as director of the Institute for Security Technology Studies at Dartmouth
College, a national counter-terrorism and cyber security research center,
and as the founding chairman of the Institute for Information Infrastructure
Protection (I3P), a consortium of leading cyber security research organizations.
From 1998 to 2001, Mr. Vatis was the founding director of the National
Infrastructure Protection Center (NIPC), an interagency organization responsible
for detecting, warning of, and responding to cyber attacks. From
1994 to 1998, Mr. Vatis served as associate deputy attorney general and
deputy director of the Executive Office for National Security at the U.
S. Department of Justice, where he was responsible for coordinating the
department's activities in the areas of counter-terrorism, counterintelligence,
infrastructure protection, and cyber crime. From 1993 to 1994, Mr. Vatis
was special counsel at the U. S. Department of Defense. Mr. Vatis also
served as a law clerk for U.S. Supreme Court Justice Thurgood Marshall
and for then-Judge Ruth Bader Ginsburg on the U.S. Court of Appeals for
the District of Columbia Circuit. Mr. Vatis earned his law degree from
Harvard Law School in 1988, graduating Magna Cum Laude and serving as Supervising
Editor of The Harvard Law Review. He received his undergraduate
degree, also Magna Cum Laude, from Princeton University.

Richard J. Varn is President and founder of RJV Consulting. His firm,
founded in 1988, serves public and private sector clients and specializes
in information technology, business strategy, innovation, and public policy
consulting. He is a Senior Fellow with the Center for Digital Government,
a Technology Policy Advisor to the National Retail Federation, and serves
on the Board of Trustees for the Educational Testing Service. He is currently
engaged as the Chief Technology Officer for the Business Gateway, a federal
initiative to implement enterprise e-forms solutions and streamline regulatory
processes. Mr. Varn's first career was in public service. He began in 1981
as a state legislative staff person. He went on to win elected office and
served as a State Representative for four years and as a State Senator
for eight years. During that time, he was twice elected Majority Whip,
created and chaired the first Communications and Information Policy Committee,
and chaired the Education Appropriations, Human Services Appropriations,
and Judiciary Committees. He was the first Iowa legislator to install and
use a computer in the Iowa legislative chambers. He left the legislature
in 1994 to teach and be Director of Telecommunications and IT Production
Services at the University of Northern Iowa. There he led a successful
reorganization of the technology departments and created numerous innovative
e-learning programs. He returned to state government in 1999 to create
the state's first Information Technology Department, and he served as its
first Director and as the state's first CIO. Mr. Varn returned to full-time
consulting in 2003. Mr. Varn has received numerous awards and recognitions
for his public service. He was named twice to the Federal 100, he received
the National Association of State Chief Information Officers Outstanding
Achievement Award in the Field of Information Technology for Iowa's Return
on Investment Program, and he received the Award for Outstanding Support
for Distance Learning from the Iowa Distance Learning Association. His
degrees and academic honors include membership in Phi Beta Kappa and numerous
other honor societies, a B. A. with honors in Political Science, and a
Juris Doctorate with distinction from the University of Iowa.

Thomas Jarrett has served as Chief Information Officer/Cabinet Secretary
of the Delaware Department of Technology and Information (DTI) since his
appointment by the governor in February 2002. As the Chief Information
Officer/Secretary of DTI, Secretary Jarrett is responsible for all of the
state's information technology needs. He is also is managing the transition
from the Office of Information Services to the new Department of Technology
and Information until June 30, 2003, when the Office of Information Services
will cease to exist. In addition to serving as the Governor's chief advisor
on technology matters, Secretary Jarrett chairs Delaware's Technology Investment
Council and is a member of the E911 Advisory Board. Secretary Jarrett also
is an active member of the National Association of State Chief Information
Officers (NASCIO), an association of chief information officers from the
50 states, six U.S. territories, and the District of Columbia. He was recently
elected as Vice President of NASCIO. Secretary Jarrett came to his current
position after 30 years of service with Verizon Delaware where he had worked
in various areas of new technology deployment and as Director of Government
Affairs.

In his current position at IBM as an e-Business Solution Executive,
Mr. Clark works with state and local governments throughout
the Americas to identify opportunities for utilizing existing and emerging
technologies to restructure governmental programs and operations. He assists
governments in understanding how these technologies can improve citizen
and business services, enhance economic development, provide for more efficient
operations and redefine communities and governance. In a prior position
with IBM, Mr. Clark managed the IBM relationship with state and local governmental
entities in the Carolinas. Mr. Clark also has held positions as Deputy
State Controller for Information Resource Management for the State of North
Carolina and as a Senior Manager of National Government Services Practice
for KPMG Peat Marwick. From June 1992 though June 1994, Mr. Clark served
as Executive Director of State Government Performance Audit for the North
Carolina General Assembly, and prior to that he was a performance auditor
for the North Carolina Department of State Auditor. He has served as a
member of the North Carolina General Assembly's Joint Technology Committee
and as a member of the steering team for the Institute of Government's
Public Technology Center at the University of North Carolina at Chapel
Hill. Mr. Clark holds a B. A. degree from the University of North Carolina
at Chapel Hill and is a Certified Public Accountant.

Prior to being named Deputy Chief for the FCC's Consumer and Governmental
Affairs Bureau, Ms. Egler was the Associate Bureau Chief for Policy in
the Consumer Information Bureau (CIB). Prior to joining CIB, she was Assistant
Chief in the Policy and Program Planning Division, Common Carrier Bureau.
Ms. Egler also served as Assistant Counsel and Director of Regulatory Affairs
for Post-Newsweek Cable, Inc. (now Cable One) in Phoenix, Arizona.She received
her LL.M. from the University of Pennsylvania, a J.D. from the University
of Pittsburgh, and a B.A. from Duke University.
Jeff Kramer, Senior Legislative Representative

Jeff Kramer is Senior Legislative Representative in the Federal Affairs
Department of AARP where he represents the Association in Washington on
utility, telecommunications, death care and consumer fraud issues. Prior
to joining AARP in 1997, Jeff was the Manager of Political Affairs at the
Edison Electric Institute where he worked for nine years. His duties at
EEI entailed representing the electric utility industry on Capitol Hill
and within the Executive Branch. A native of Brooklyn, New York, Jeff received
his B.A. in American Government from the University of Virginia and his
J.D. from George Mason University. He is a member of the Federal Communications
Bar Association and was recently reappointed to a second term on the Consumer
Advisory Committee at the FCC.

Joseph Sanscrainte is the Director of Regulatory Affairs and General
Counsel for Call Compliance, Inc., located in Glen Cove, New York. Mr.
Sanscrainte serves as Co-Chair of the American Teleservices Association
State Legislative Committee, and is a member of the American Resort Development
Association's State Legislative and Technology Sub-Committees, the American
Teleservices Association Education and Government Affairs Committees, and
the Direct Marketing Association's Teleservices Council. Mr. Sanscrainte
is regularly sought after as a speaker and writer on do-not-call compliance
and related technology issues, most recently taking part in both the American
Teleservices Association and Newspaper Association of America 2003 national
