FY 2008 Appropriations

The U.S. House has approved six of its 12 annual appropriations bills.  The U.S. Senate Appropriations Committee has adopted all but two of its 12 appropriations bills (see table 1).  The full Senate is currently expected to take action on only one of the FY 2008 spending bills (homeland security) prior to the August recess.

FY 2008 Senate Energy & Water Markup
On June 28, the Senate Appropriations Committee on Energy & Water adopted the $32 billion Department of the Interior and Environment Appropriations Act for FY 2008 (S. 1751), which includes: $240 million for weatherization grants, $36 million above FY 2007 levels; and $55 million for state energy programs, $5 million above FY 2007 levels. 

FY 2008 Senate Commerce/Justice/Science
On June 28, the Senate Appropriations Committee on Commerce/Science/Justice adopted the Science, State, Justice, Commerce, and Related Agencies Appropriations Act for 2007 (S. 1745). The bill provides $56.0 billion for the Department of Commerce, Justice and related programs, approximately $3.5 billion above FY 2007 levels. The bill includes:

  • $1.4 billion for state and local law enforcement assistance, $163 million above FY 2007 levels, which includes:
  • $660 million for Edward Byrne Justice Assistance Grants, $140 million above FY 2007 levels;
  • $190 million for Byrne Discretionary Grants, $80 million above FY 2007 levels;
  • $400 million for the State Criminal Alien Assistance Program, equal to FY 2007 funding levels; and
  • $550 million for the Community Oriented Policing Services (COPS); $9.0 million above FY 2007 levels.

S. 1745 also includes a $37.5 million rescission of unobligated balances under the COPS program.  

FY 2008 Senate Interior and Environment Appropriations

On June 21, the U.S. Senate Appropriations Committee adopted the Department of the Interior and Environment Appropriations Act for FY 2008 (S. 1696). The bill provides $27.15 billion for discretionary programs for the Department of the Interior, Environment and Related agencies, including:

  • $887 million for the Clean Water State Revolving Funds, $238 million below House FY 2008 levels;
  • $1.274 billion for Superfund, $2 million above House FY 2008 levels;
  • $232 million for Payment in Lieu of Taxes, $20 million above House FY 2008 levels; and
  • $3.181 billion for state and tribal assistance grants (STAG), $225 million below House FY 2008 levels.

FY 2008 Senate Labor, HHS, Education Appropriations Markup
On June 19, the Senate Appropriations Subcommittee on Committee on Labor, Health and Human Services and Education adopted the Department of Labor, Health and Human Services and Education Act for FY 2008, which includes: 

Department of Labor
The Committee appropriated $11.8 billion for Department of Labor programs, $209 million above FY 2007 levels, which includes:

  • $864 million for Adult Job Training (including advance funding), equal to FY 2007 levels;
  • $940 million for Youth Job Training, equal to FY 2007 levels;

Department of Health and Human Services
The Committee appropriated $68.2 billion for Department of Health and Human Services programs, $4.1 billion above FY 2007 levels, which includes:

  • $670 million for the Community Services Block Grant, $40 million above FY 2007 levels;
  • $2.06 billion for the Child Care and Development Block Grant, equal to FY 2007 levels;
  • $2.16 billion for the Low Income Home Energy Assistance Program (LIHEAP), equal to FY 2007 levels; and
  • $2.17 billion for the Ryan White AIDS Program, $33 million above FY 2007 levels. 

Department of Education
The Committee appropriated $61.7 billion for Department of Education programs, nearly $2.0 billion above FY 2007 levels, which includes:

  • $19.9 billion for Title I grants to local education agencies (No Child Left Behind), $1.07 billion above FY 2007 levels; 
  • $11.2 billion for the Individuals with Disabilities Education Act (IDEA), $457 million above FY 2007 levels;
  • $2.89 billion for State Grants to Improve Teacher Quality, equal to FY 2007 levels;
  • $272 million for Education Technology State Grants, equal to FY 2007 levels; and
  • $1.18 billion for Career and Technical Education State Grants, equal to FY 2007 levels.

FY 2008 Senate Homeland Security Appropriations Markup
On June 14, the U.S. Senate Appropriations Committee adopted the Department of Homeland Security Appropriations Act for FY 2008 (S. 1644). The bill provides $37.6 billion in discretionary funds, $1.3 billion above the House bill. The bill includes:

  • $525 million for the State Homeland Security Grant Program, $25 million below House FY 2008 levels and equal to FY 2007 appropriations;
  • $375 million for the Law Enforcement Terrorism Prevention Program, $25 million below House FY 2008 levels and equal to FY 2007 appropriations;
  • $820 million for the Urban Area Security Initiative, $20 million above House FY 2008 levels and $50 million above FY 2007 appropriations;
  • $33 million for the Metropolitan Medical Response System, $17 million below House FY 2008 levels and equal to FY 2007 appropriations;
  • $300 for the Emergency Management Performance Grants, equal to House FY 2008 levels and $100 million above FY 2007 levels;
  • $400 for Port Security Grants, equal to House FY 2008 levels and $190 million above FY 2007 levels;
  • $400 for the Transit Security Grants, equal to House FY 2008 levels and $225 million above FY 2007 levels;
  • $0 to assist states with the implementation of the Real ID, $50 million below House FY 2008 levels; and
  • $0 for the Interoperability Grant Program, $50 million below House FY 2008 levels.

The bill includes a provision that would prohibit the preemption of state chemical security laws and regulations that are more stringent than those established by the Department of Homeland Security under the FY 2007 DHS Appropriations Act (P.L. 109-395).
