FY 2007 Appropriations Bills

The House has passed all but one of its appropriations bills – Labor/HHS/Education bill.

The Senate Appropriations Committee has passed eight of its twelve annual appropriations bills: Agriculture, Legislative Branch, Energy & Water, Interior, Homeland Security, State/Foreign Operations, District of Columbia, and Commerce/Justice/Science.

SENATE FY 2007 APPROPRIATIONS

Senate: Homeland Security

On July 13, the Senate passed the Department of Homeland Security Appropriations Act for FY2007. Here are its most significant features:

  • Fails to provide any funds for state implementation of the REAL ID.
  • Provides $500 million for state formula-based grants ($45 million below the House approved level).
  • Provides $1.165 billion for high-density urban areas, similar to FY2006 levels, including: 
    • $745 million for urban area grants ($5 million below the House approved level);
    • $150 million for rail security (equal to the House approved level);
    • $210 million for port security ($10 million above the House approved level); and
    • $220 million for Emergency Management Performance Grants (EMPG) ($37 million above FY 2006 levels and $40 million above the House approved level).

Senate: Science, State, Justice, Commerce

On July 13, the Senate Appropriations Committee approved the Science, State, Justice, Commerce, and Related Agencies Appropriations Act of 2007 (H.R. 5672). Here are its most significant features:

  • Provides $810 million for state and local law enforcement assistance  ($413 million below FY2006 levels, $390 million below the House approval, and $810 above the President’s FY2007 request). The appropriations include:
    • Provides $100 million for the State Criminal Alien Assistance Program (SCAAP), $315 below the House approval and nearly $300 million below FY2006 levels. The President FY2007 budget request eliminated funds for this program; 
    • Provides $555 million for the Edward Byrne Justice Assistance Grants program, $79 million below the House approval and $143 million above FY2006 levels. The President’s FY2007 budget request eliminated funds for this program; and
    • Provides $120 million for the Edward Byrne Discretionary Grants program, $120 million above the House approval and $69 million below FY2006 levels. The President’s FY2007 budget request eliminated funds for this program.
  • Provides $390 million Violence Against Women (VAWA) programs ($28 million below the House approval, $8.4 million above FY2006 levels and $43 million above the President’s request).
  • Provides $537 million for the Community Oriented Policing Services (COPS) programs, ($80 million above FY2006 levels, $4 million above the House request, $435 million above the President’s request). The appropriations include:
    • $85 million for methamphetamine hot spots ($22 million above FY2006 levels and $44.9 million above the President’s request).
  • Rescinds $127 million from unobligated balances under the justice assistance grants.
  • Rescinds $127 million from unobligated balances under COPS.

BUSINESS ACTIVITY TAX

On July 11, the Congressional Budget Office (CBO) released a cost estimate for the Business Activity Tax Simplification Act of 2005 (H.R. 1956). H.R. 1956 preempts state law by establishing a 21-day, physical presence standard for business activity taxes.  CBO estimates that H.R. 1956 would cost states more than $1 billion in the first full year after its enactment and increase to about $3 billion annually by 2011.
