To link legislators, legislative staff, and interested private sector entities to analyze legislators’ needs and to develop nonpartisan, balanced, and useful materials to aid legislators’ decision-making, both in their respective states and as they consider state-federal relationships.  The P3s Partners Project will largely focus on publicly held surface transportation systems – namely roadways – but may incorporate linked water-based systems or intermodal installations as Project time and resources permit.

The initial 18-month Project (2008-2010) was designed to:

  • Develop and offer educational sessions;
  • Develop and provide a Legislative P3 Toolkit, including, but not limited to, items legislators and staff can use to:
    • Evaluate the merits of P3s when considering implementing legislation,
    • Assist state transportation officials as they evaluate tenders and bids,
    • Understand P3 contracts,
    • Oversee the operation and performance of P3s, and
    • Respond to public and press inquiries about P3s;
  • Develop greater NCSL expertise on P3s, offer episodic technical assistance upon request from legislators and staff, and increase capacity to respond to information requests; and
  • Inform the NCSL Transportation Committee’s deliberation of P3s in the context of state-federal relations.

NCSL PPP Partners Project: Phase II

New and renewing sponsors are invited to join and support Phase II of the ongoing work led by the NCSL Working Group on Transportation Public-Private Partnerships (PPPs). This group worked for 18 months (2008-2010) to formulate guiding principles for state legislatures to use when considering the application of PPPs for the development of transportation infrastructure. The report containing these principles was released in December 2010, and will help address the well-documented gap in expertise among elected officials about PPPs in the United States.

The next step is a focused educational and awareness effort. Following the release of the PPP Principles Toolkit in December 2010, NCSL has embarked upon a 12-month, Phase II of the project to accomplish the following tasks:

  • Widely disseminate the PPP Toolkit and findings;
  • Analyze and categorize PPP enabling statutes for transportation;
  • Upon invitation, provide technical assistance to individual state legislative entities; and
  • Continue NCSL PPP Working Group meetings and host educational sessions on PPPs at NCSL meetings.

In addition, during Phase II, NCSL has produced a two-page LegisBrief that summarizes some of the findings from the PPP Toolkit.
