2012 Prevailing Wage Legislation

calculatorSeventeen states considered legislation related to prevailing wages on public works projects during the 2012 legislative session. Five states passed a total of eight bills on prevailing wage requirements. Prevailing wage laws require that wages for construction workers on public works projects be calculated to reflect local wages for similar jobs.



Summary of 2012 Enacted Prevailing Wage Legislation

California enacted three laws related to prevailing wage. The first was a budget bill which provides funding for education-related capital projects and requires that contractors and subcontractors meet prevailing wage requirements. (SB 1028) The second bill requires the Director of Industrial Relations to publish on the Internet a list of state code sections and the statutory texts related to prevailing wage requirements on public works projects.  (SB 1370)  The third bill establishes that increased employer payments for costs and benefits on public works projects resulting in a lower wage shall not be considered a violation of the prevailing wage law as long as the increased employer payment is made pursuant to terms in a collective bargaining agreement and that the hourly straight time and overtime wages combined are no less than the applicable prevailing wage. Illinois amended the state prevailing wage law by requiring a stipulation in public works contracts that the current prevailing wage rates are published on the labor department’s website and this constitutes adequate notice. (HB 5212)
 
New York passed a bill making permanent a formerly temporary section of state prevailing wage contracts.  (AB 9832)
 
Rhode Island passed a law that requires state agencies to provide records and tax information certified as necessary to investigate prevailing wage and other labor law violations under the department’s jurisdiction when probable cause exists to suspect a violation has occurred.  (SB 3039)
 
Virginia enacted two laws related to economic development targeted to expand Virginia’s agricultural and forestry industries by providing grants and loans for local projects, which must meet prevailing wage requirements. (HB 766, SB 128)
