2011 Sick Leave Legislation

2011 Sick Leave Legislation

Bills on sick leave were introduced in 29 states and Puerto Rico during the 2011 legislative session.  Ten states enacted laws related to sick leave, including ground-breaking legislation in Connecticut, which became the first state to pass a law requiring private sector employers to provide paid sick leave.  Below is a brief overview of enacted legislation, followed by a summary of all 2011 legislation related to sick leave.

Summary of Enacted Bills

Arkansas passed two sick-leave related bills.  The first addresses teacher’s use and make-up of sick days on mandatory professional development days.  The second clarifies state law on payment for unused sick leave for employees of state funded colleges.

Connecticut passed a law requiring that paid sick leave be provided by private sector employers with 50 or more employees, with certain exceptions.

Hawaii passed a law making it illegal to take negative employment actions against employees who use available sick time.

Idaho enacted a law repealing a provision allowing the state board of education to establish uniform criteria for the use of sick time.

Louisiana passed a law allowing school districts not to comply with state law requiring extended sick leave for school employees during years when specific fiscal criteria are met.

New Hampshire passed a bill regarding accrual of sick time of judicial branch employees who transfer to the executive branch.

New Jersey passed two active carry-over bills from the 2010-2011 legislative session.  The first limits the dollar amount that can be paid to a current state employee for accrued sick leave when they retire.  The second established the same limits on the payment of accrued sick leave for new state employees when they retire but the bill was vetoed by the governor.

North Dakota enacted two bills.  The first addressed retirement benefits for state university and state highway patrol employees.  The second increased from 40 to 80 hours the amount of available leave a state employee may use for family leave.

Tennessee passed a law entitling members of the Tennessee State Guard or Civil Air Patrol to unpaid leave for times they are called to duty in the service of the state.

Texas amended current law providing for retirement benefits and the calculation of accrued leave for municipal employees.

Summary: Relates to employees in military service; provides that all public employees and all private sector employees who are, or may become, members of the State Guard and Civil Air Patrol shall be entitled to an unpaid leave of absence from their respective duties, without loss of time, pay, regular leave or vacation, or impairment of efficiency rating, for all periods of service during which they are engaged in the performance of duty or training in the service of this state, under competent orders.
