Introduction

The U.S. Supreme Court’s decision in Kelo vs. New London on June 23, 2005, which affirmed the use of eminent domain for economic development that provides a public benefit, has generated much angst and activity in state legislatures. Private property advocates contend that the decision means “no house is safe,” while local government officials argue that eminent domain is a necessary tool to revitalize rundown areas.
