Electronic Surveillance 2004 Enacted Legislation
California A.B. 2840 Chaptered by Secretary of State. Chapter No. 317 Bans a rental company that uses electronic surveillance technology in its rental vehicles from using, accessing or obtaining information relating to the renter's use of the rental vehicle that was obtained using that technology. Requires a rental company to obtain a renter's express authorization before using or disclosing to others information about the renter's use of the vehicle
Massachusetts H.B. 4863 Chapter No. 395-2004 Among other things, prohibits photographing, videotaping or electronic surveillance of another person who is nude or partially nude with a reasonable expectation of privacy
Michigan H.B. 5693 Public Act No. 157 Provides sentencing guidelines for crimes of electronic surveillance. Also relates to electronic eavesdropping and dissemination of lewd images.
Michigan H.B. 6177 Public Act No. 460 Relates to electronic surveillance; bans capturing certain personal identifying information without consent. Also relates to cellular telephones and credit cards.
New Hampshire H.B. 1380 Chapter No. 212 Creates a criminal penalty for unauthorized video surveillance; includes broadcasting images and recordings of sexual activity.
Oklahoma H.B. 1615 Deals with tampering with security or surveillance equipment. Unauthorized tampering, manipulation, disconnecting or repositioning of security or surveillance cameras for the purpose of avoiding detection is now a felony. Creates criminal penalties for using surveillance equipment to avoid detection.
Oklahoma S.B. 1331 Chapter No. 289 Provides for emergency oral authorization from a judge to intercept specified electronic communications and specifying time limitation of authorization.
Virginia H.B. 650 Acts of Assembly. Chapter No. 149, Criminalizes intentionally using contents of intercepted wiretap, electronic or oral communications.
