Uniform Electronic Transactions Act

The Uniform Electronic Transactions Act (UETA)  provides a legal framework for electronic transactions.  It gives electronic signatures and records the same validity and enforceability as manual signatures and paper-based transactions.  This model act was adopted by the National Conference of Commissioners on Uniform State Laws (NCCUSL) in 1999.  To see the full text of the act and additional information, see the NCCUSL web site, http://www.nccusl.org/.

Electronic Signatures in Global and National Commerce Act

Congress enacted the Electronic Signatures in Global and National Commerce Act (E-SIGN) that also establishes the validity of electronic records and signatures. It governs in the absence of a state law or where states have made modifications to UETA that are inconsistent with E-SIGN. By adopting the official version of UETA, states have the authority to modify, limit or supersede some E-SIGN provisions, including its consumer protection provisions.
