Public Health Council of the Ohio Department of Health Proposes Rule Changes Concerning Isolation Requirements, Communicable Disease Reporting and Standards for Radioactive Materials

The Public Health Council of the Ohio Department of Health has proposed to adopt amendments to the Ohio Administrative Code (O.A.C.) that would add new requirements for reporting of communicable disease, alter current isolation requirements and establish standards for use of radioactive materials. Amendments to communicable disease reporting requirements add to the "Class A" list of reportable diseases viral hemorrhagic fever, yellow fever, various forms of encephalitis and amend some of the criteria for the reporting of meningitis and chlamydia. Isolation requirements will be altered to include smallpox, viral hemorrhagic fever and yellow fever as one of the specified diseases or conditions that must be isolated. The rules also provide additional guidelines for childcare providers who have specific conditions concerning their ability to return to work.

Specific standards for persons manufacturing and distributing items containing radioactive material to licensed organizations were also established. These rules include requirements for issuance of licenses to possess these materials and registration of the products. The rules have been proposed to reflect the current Centers for Disease Control and Prevention (CDC) guidelines.

The council will conduct public hearings on the proposed actions on Thursday, August 8, 2002.

The Iowa Department of Public Health Adopts New Rules to Prepare for Exposures to Biologic Agents

New rules were adopted and filed at the July 10th meeting of the Iowa Board of Health to establish a biosecurity council to advise the Public Health Department on biosecurity issues and to recommend guidelines for protection against exposure to biologic agents. The adopted rule, established as Chapter 112, Biological Agent Risk Assessment, requires any laboratory, clinic, research facility, commercial enterprise or other entity that possesses selected biologic agents to complete and submit an emergency management division biological agent risk assessment questionnaire on an annual basis or more frequently as requested. The new questionnaire will be used in the development of a critical asset protection plan by the Department of Public Health. The rule also provides the department with the authority to conduct an on-site examination of any premises containing select biologic agents. On-site examinations are to include an assessment of laboratory safety and security policies, facility access controls, review of the emergency plan, biocontainment procedures, training and knowledge of the staff and processes for reporting breaches of security. 

Health Facility Preparedness Legislation

As a part of public health emergency preparedness efforts, each state will turn to state and local hospitals to assess readiness and rely on that capability to lead the response effort in the event of casualties resulting from terrorist activities. The federal agency Health Resources and Services Administration (HRSA), provided each state the opportunity to apply for federal moneys to upgrade the preparedness of hospitals and health care systems to respond to bioterrorist events as well as outbreaks of infectious and rare diseases. The federal grant requires each state to conduct an assessment of hospital bioterrorism preparedness before awarding funds to hospitals and to convene a Hospital Bioterrorism Preparedness Planning Committee to make recommendations on the priorities and process to provide funding to hospitals. Toward this effort, five states-Delaware, Kansas, Maryland, Michigan and Tennessee-have established a mechanism of evaluating their health facility preparedness

Delaware House Bill 377, enacted July third, requires the Commission of the Department of Health and Social Services to establish a hospital bio-preparedness planning subcommittee, whose composition will include representation from the Delaware Emergency Management Agency, the department itself, the medical community, and local emergency medical services.

In Kansas Executive Order 9, issued in February, establishes the Kansas Bioterrorism Hospital Preparedness Planning and Advisory Committees. The Planning Committee will include representatives from a variety of state agencies, institutions, groups and others as necessary to carry out the duties of the committee. The committee will conduct a needs assessment and planning process according to law, including:

      1. Areas of preparedness planning and readiness assessment,
      2. Surveillance and epidemiology capacity,
      3. Laboratory capacity (biologic agents),
      4. Laboratory capacity (chemical agents),
      5. Health alert network/communications and information technology
      6. Risk communication and health information dissemination and
      7. Education and training.

The committee will also establish timelines for the development of a state-wide plan, regional plans and assessment of emergency preparedness and response capabilities related to bioterrorism, reference the attached "Critical Benchmarks for Bioterrorism Preparedness Planning".

This document will be filed with the Secretary of State and became effective immediately.

The State of Maryland enacted health facility contingency planning requirements to provide that the Secretary of Health and Mental Hygiene may require health care facilities to develop and implement contingency plans addressing:

(i) staff training needs;

(ii) stockpiling of equipment, medication, and supplies necessary to address a catastrophic health emergency;

(iii) treatment and decontamination protocols;

(iv) the coordination of services with other public and private entities; and

(v) any other area that the secretary determines is necessary to assist in the early detection and treatment of an individual exposed to a deadly agent.

The act requires that the new procedures to be adopted by the department be consistent with accreditation requirements of the Joint Commission on the Accreditation of Health Care Organizations (JCAHCO). After consulting with the appropriate licensing board, the secretaries required to publish protocols to assist health care practitioners in developing plans to respond to a catastrophic health emergency; and may require health care practitioners to implement the plans developed when necessary.

The Michigan legislature enacted a measure, S 287, that requires the Department of Community Health to provide to the chairpersons of the Senate and House of Representatives Appropriations Subcommittees on Community Health and to the Senate and House Fiscal Agencies semiannual progress reports on the Michigan public health preparedness and response to bioterrorism initiative, including a detailed budget narrative and copies of the needs assessment and implementation plan for the Michigan hospital preparedness plan when completed by the department of community health, including a detailed budget narrative.

The State of Tennessee established the Hospital Bio-preparedness Planning Committee. The act creating the committee charges them with the responsibility of recommending to the governor a time-line for development and implementation of a system of regional hospital plans. The measure outlines that each regional plan should be capable of accommodating at least 500 patients in an emergency arising from a bioterrorism event, infectious disease outbreak or other public health emergency. The committee will also recommend statutory changes necessary to implement the recommendations of the committee.

 2002 Statutory Authorities Enacted for Examination, Treatment and Quarantine of Exposed Persons

Mandating Examination and Treatment

    • Arizona House Bill 2044 allows the governor along with the Director of the Department of Health Services to mandate medical examinations for exposed persons and treatment or vaccination of persons diagnosed with resulting illness.
    • Delaware House Bill 377 grants the public safety authority the power to direct vaccination or treatment of persons. Public safety authority means the Director of the Delaware Emergency Management Agency or such other person as the Governor may designate. The act also provides the authority the right to isolate or quarantine any individual who is unable or unwilling to cooperate.
    • Florida Senate Bill 1262 grants the State Health Officer the authority to order examination, tests, vaccination or treatment for communicable diseases that pose a serious danger to the public health. Also allows the State Health Officer to quarantine individuals who are unable or unwilling to submit to this authority for reasons of health, religion or conscience.
    • Maine House Bill 1656 grants the Department of Health the authority to take a person into custody and order prescribed care of that person. Provides exemption for individuals if alternative public health measures are available or if the individual demonstrates a sincere religious or conscientious objection or is a known risk of serious adverse reaction.
    • Maryland Senate Bill 234 empowers the governor to order the Secretary of Health and Mental Hygiene to require individuals to submit to medical examination and testing and vaccination, unless the vaccination or medical treatment will cause serious harm to the individual.
    • Minnesota House Bill 3031 provides that an individual has the right to refuse examination, treatment, testing and vaccination but may be subject to isolation and quarantine in the event that it is reasonably believed they may have been infected with the communicable disease.
    • New Hampshire House Bill 1478 empowers the Commissioner of the Department of Health and Human Services to compel the vaccinations of individuals to prevent the spread of disease. Specifies that individuals refusing treatment of vaccination will be guilty of a misdemeanor and provides for the issuance of a complaint by the Commissioner to the Justice of the Peace for enforcement of the complaint. Also provides for due process of law for any individual that refuses.
    • South Carolina House Bill 4416 empowers the Department of Health and Environmental Control (DHEC) to vaccinate or treat persons to prevent the spread of contagious disease and to isolate or quarantine persons unable or unwilling for any reason to submit to the order.

Issuing an Order for Isolation and Quarantine

    • Arizona House Bill 2044 specifically limits quarantine authority of the governor in consultation with the Director of the Department of Health Services to be related to a public health emergency for only those persons posing a threat because of exposure to smallpox, plague, viral hemorrhagic fevers or highly contagious and highly fatal disease with transmission characteristics similar to smallpox. Addresses the authority of local health authorities to order isolation and quarantine and outlines an individuals right to due process of law related to the order.
    • Colorado Senate Bill 185 amends quarantine authorities to grant the Chief Medical Health Officer the right to quarantine or isolate an individual patient with multidrug-resistant tuberculosis if the patient has ceased taking prescribed medications against medical advise.
    • Delaware House Bill 377 allows the public safety authority to isolate or quarantine any persons who refuse medical examination or testing in the case where exposure to a contagious disease may pose a threat to the public health.
    • Florida Senate Bill 1262 grants the State Health Officer the authority to order quarantine for communicable diseases that pose a serious danger to the public health.
    • Hawaii House Bill 2521 amends existing quarantine laws by establishing the conditions under which a quarantined individual may be held. It provides for details concerning the individuals needs, the condition of the premises and requires considerations for cultural and religious needs. Provides an individual with due process of law to concerning a quarantine order.
    • Maryland Senate Bill 234 empowers the governor to order the Secretary of Health and Mental Hygiene to require individuals to submit to isolation and quarantine. Provides for the process by which a quarantine order may be issued. Also provides an individual with due process of law to contest the directive.
    • Minnesota House Bill 3031 amends existing quarantine laws by providing more detail on the conditions under which an individual may be held. Also provides for the process of issuance of an order to isolate or quarantine an individual.
    • New Hampshire House Bill 1478 requires the Commissioner of the Department of Health and Human Services to establish isolation and quarantine for persons who pose a threat to the public health. Defines the restrictions and penalties associated with a quarantine order. Also provides for due process of law for any individual that refuses.
    • New Mexico House Bill 195 requires a public health official to petition the court for an order to detain any individual who refuses treatment if they have been diagnosed with a communicable disease.
    • South Carolina House Bill 4416 empowers the Department of Health and Environmental Control (DHEC) to isolate or quarantine persons who have not been vaccinated, treated, tested or examined prevent the spread of contagious disease.
