Fall Meeting 2006

Business

- Letter requesting NRC share security info with states.  More under NRC Update section.
- Interim Storage bill - $10 million.  MW against using Nuclear Waste Fund (NWF) dollars for it.
- S.2589 - Resolution opposing it, exec. board Dec. 11.
- DOE TEC released shipping campaign lessons learned.  MW believes it is a good start, but needs more detail.  Look at FRR and foreign experiences.  Disagree that enroute inspections are not needed; states want to inspect.


Project Update

- Elections completed; now need appointments from new governors.
- Need 10 new legislative appointments.  Hope gubernatorial appointees can help.  (See further discussion in legislator involvement section)
- Survey of states - summary will be final after get comments back from at least two regions.
- New planning guide.
- Lessons learned report on traffic accident when LLW was transported from Fernald to Texas.  Jane Beetem (MO) to present at Waste Management Conference in Tucson in spring.
- WI Legislative Council Committee on Nuclear Energy examining whether state should lift its moratorium on construction of new nuclear plants.  17 committee members, some staff.  Will tour Yucca mountain on Dec. 5.  Dec. 14 meeting in Madison.  Will decide on moratorium thereafter.


TEC Working Group Reports

RAIL:
Inspections - Draft of rail shipment inspection checklist.  But not sure what is already being done.  Take those out.  Final purpose is to build state confidence to lessen number of inspections required along route.
Lessons learned - TEC project now 20 pages.  Exec. summary in the works.  Will present at next TEC in January.
Security - Troubles with members not having clearances.  Now halted.
Planning - Timeline done, but is a living document.           

MANUAL:
Practices manual going through DOE review now (Ella McNeil), perhaps done next Feb., March, April.

SECURITY:
Sunsetting.  Classification guide to equate language throughout DOE docs.  Transmission of security info important to locals, so working with NRC on this.

180(c):
State fees not to be taken out of 180(c) allotment.  180(c) just for training.
Funding allocation method unresolved:
            WGA proposed 75% shipment miles, 25% discretionary.  Withdrawn - should be based on needs assessment, not formula.
            MN proposed 30% shipment miles, 30% number of shipments, 30% population, 10% number of shipment sites.
Currently working on:
            Principles of agreement
            Grant application package
            Pilot 180(c) program

ROUTING:
- Draft task plan for group created.  MW to comment on:
            Would prefer working through plan in order versus simultaneously with subgroups.  
            Also concerned about looking at rail routes only to start - should do along with trucking since rail will likely not be ready for some initial shipping campaigns.
- MW not to lead since they've completed their region, but to inform.
- Conference calls monthly, then every other month.


Meetings

- US Transport Council, DC in June.
- NCSL Annual Meeting, Nashville in August.
- Midwest Legislative Council - took up policy on Interim Storage.
- WGA/SSEB/NCSL joint meeting, San Diego in Oct.  Interesting mix of state agency people and legislators.  Explained NEI bill which still includes contentious Section 7 of S.2589.


New Business

- Next meeting in Jefferson City, MO - week of May 14
- Must decide how to move forward with rail inspection checklist
- Letter to DOE on placing 180(c) decision in federal register (will do anyway)


State Updates

IL:
Closed meeting with NRC commissioners on additional security measures after 9/11.  Need to clarify what are unfunded mandates.

IN:
Transportation will be big - looking at existing funding.
Initiatives for universities - remote sensors (Purdue and IU)
West Valley truck incident on toll road
            State didn't know in advance that it was coming
            Letter to DOE on back payments for shipments of LLW from 2002-2005 (i.e. from West Valley).  DOE has not responded.

IA:
Exercise in February.
Changed fees - average shipment border to border now approx. $3,000.
Rep. Elgin legislation - puts fees into a rotation fund.  This allows the rad portion of the Dept. of Public Health to now be fully fee-funded, not dependent on general fund, so can't be cut.
Have noticed that some HLW shipments have gone around IA to avoid fees.

KS:
Fee program for Wolf Creek and Cooper.
Dedicated fund supports many related agencies.
Not able to pass legislation for transport fees.  Senator McGinn to work with group on fees.
KS legislators toured Wolf Creek when it was shut down (for refueling?).  They are currently seeking a 20-year operating extension.
Exercises in Wine Doc County and Wolf Creek.

MI:
Four operating nuclear reactors
1 shipping reactor vessel head
2 of 3 operating plants have gone through re-licensing.  The fourth has awhile to go before license expires.
Ontario power plant proposing deep geologic disposal of all waste from reactor except SNF 2 miles from Lake Huron.

MN:
One plant just got a license renewal; will start dry cask storage.
Legislature to vote on next year.
23rd dry cask at Prairie Island.
July exercise - NEI
February 1, potassium iodide dispersion to community.

MO:
FRR shipment came through.  Worried about it hitting St. Louis during rush hour since there is no holding place.  A lot of staff time spent on this.
Fees will be proposed again in the legislature next year.

NE:
Nothing

OH:
CT, NJ sent in letters on federal legislation.  OH governor not interested.
Perry 1 power plant conference and exercise, by invite only.
State Legislation - no progress on either bill proposed
            Study commission on transport of HLW
            Fees

EM Update

Recently declared physical completion of:
            Fernald Silo 3
            Mound/Miamisburg
            Battelle Columbus

Shipping campaigns:
            DUF6 from Oakridge to OH (Paducah and Portsmouth) done in Dec. 2006.  The waste will be converted 
            to depleted uranium oxide (a solid) there and then shipped to NTS or EnergySolutions for disposal.  
            Shipments form Paducah for 25 year, from Portsmouth for 18 - 3,000 combined canisters 
            per year, 5 or 6 railcars per week.
WIMS - forward looking waste mgmt info system.  Near-term tracked with the Prospective Shipments Module.
Meetings - Jan. 30 and 31 to determine what should count as a transportation incident.

Q&A:
- EM doesn’t inform states of LLW shipments, so not paying fees.
Comment - State may need to assess penalties.  Contractors are required by law to pay fees.
Indiana should get a response soon - Ella McNeil aware of concerns.

- FRR not included on Prospective Shipments Module because it is an EM doc and FRR are NNSA shipments.  University reactors also not included - usually not required to pay fees.

Bill Mackie, Waste Isolation Pilot Plant
TRANSCOM Communications Center (TCC) responsibilities versus Central Monitoring Room Operator responsibilities (CMRO).
State responsibilities for messaging - communicate critical info regarding shipments to CMRO, TCC, other states, and POEs
TRUPACTIII - square design.  Tested in Albuquerque past 2 weeks.  No leaks - some tests broke the skin, but not the inner integrity.
NRC full-scale computer simulation to come, will see how it matches up.

 

WIPP Update (PowerPoint available upon request)
Ralph Smith, Manager, Institutional Program, DOE
Reached 5,000 shipments on Sept. 11 (about ¼ done)
TRU, defense-related wastes.  Radiation levels low - contact handled.
Recently received permit to take remote-handled (RH) wastes - higher activity, packaging shielded on these.
Road show, spring 2007, through states for pilot inspections, etc.

Carrier audits by SRGs (3rd party independents).
Mid '07 - evaluating small sites
            From Argonne - Knolls Atomic, Bettis, Schenectady, NTS, LANL
RH from Idaho first (Jan/Feb '07), then Los Alamos - need to be aggressive before panels with space close.

RCRA, Section 311 deals with RH waste.

Earl Easton, Senior Level Advisor; U.S. Nuclear Regulatory Commission, Transportation Spent Fuel Project Office
Baltimore Tunnel Fire report due out in a couple of weeks.  Result - no release.

Suggested MW be specific in its request to NRC for security info to be distributed to the states, and only request useful info for state's role.  Much of the info he heard requested at this meeting is already available publicly.
Only thing that's changed is amount/type of radionuclides, extension to other materials.

Comment - States would like to know about cask robustness (tests), physical security, threat environment.

Earl distributed matrix he had given to MW previously to fill out that helps them narrow down request.  MW has yet to fill it out, will do so with other SRGs.  Earl will then take it to NRC security section to check on need-to-know and clearance requirements.

Northeast requests all information on cask tests; design testing for which threats.

 

Legislator Involvement and Final Comments from Group
- Info from MW and NCSL hugely important for making good public policy.  Should educate as many legislators as possible to combat TV sound bites.
- Learn a lot from tours - visual easier to grasp in this technical field.  Should involve more legislators.
- Agency people can be a resource for legislators.  Not much interaction at this point.
- Need coordination among neighboring states on CH and FRR shipments.
- TRANSCOM tour helpful for rounding out the picture.
- Important to include legislators, Yucca is where WIPP was 15 year ago - need support.
- Find legislators with reactors in their districts or on a transportation route.  Highlight shipments currently happening, many think of Yucca shipments as way out and not immediate concern.  Target select committees - but be careful as some legislators placed on committees they have no personal interest/stake in.  Go to legislative leadership for suggestions/appointments.
- Industry lobbyists can help pinpoint interested legislators.
- Use NCSL contacts.
- Promote at CSG Legislative Council sessions.

 

Action Items
- Rail Inspections Checklist - other regions and TEC not interested, FRA not on board.
- Proposed special projects - Lacrosse moving reactor head, RH shipments, Workshop next year.
- 180(c) - Should we send a letter requesting publication in federal register?  Already will happen.
- Route Identification Draft Plan - submit comments by Dec. 16.  Believe Criteria and Routing areas should involve all participants, but that Data and Tools can be subgroups.
- Domenici Bill - NCSL letter.  Governors' letters.  How do we interest MW governors?
- LLW fees - Research more about DOE payment of state fees.
