Fair Share Statutes

The terms fair share, agency fee and agency shop define the legal right of a representing body or union to collect a fee for negotiating a contract and representing employees in grievances and arbitration. Employees required to pay a fair share fee are those employees whose employment is covered by an exclusive representative or union but are not members and do not pay membership dues to that union. The following states require agency fee for certain employees.
