Prescription Drug 2009 Enacted State Laws

2009 marked a shift in legislative activities affecting prescription drugs. The overall cost of prescription drugs slowed considerably according to several surveys of 2007-2008. In January 2009, a federally sponsored study documented annual growth of prescription drug spending at 4.6 percent, lower than any other major health care sector and the lowest level in 45 years. 1

The slow-down in spending was widely seen as a hopeful sign for policymakers worried about keeping health care affordable, both to patients and to the public and private payers.

2009 Passed Laws and Resolutions

This year again was a busy one for prescription drug laws, with 84 new measures enacted among 32 states.

For the first time in a decade there was relatively little activity aimed at expanding state subsidies or discount programs for those lacking prescription drug coverage or insurance. Economic issues remained visible, with pharmaceutical benefit managers (PBM) regulation in eight states and the role of marketing and prescription record privacy making news. The reuse and redistribution of unused medicines also saw considerable action this year, with laws passed in nine states.  Medicaid pharmaceuticals were addresses by eight states. 

The Changed Patterns in Spending

Within Medicaid, prescription drug spending actually decreased 1.8 percent, with 31 states reporting spending less in 2007 than in 2006. The slowdown in costs does not mean the prescription drug market is shrinking or unimportant—it totaled 3.5 billion individual transactions, worth about $228 billion in 2007, with larger totals estimated for 2008 and 2009. In a surprising reversal back to increases, an analysis published November 2009 showed that Rx prices were rising about 9 percent by the end of calendar 2009.

The cause for the slow-down is fairly well-documented and includes:

  • Use of generic drugs, which cost on average 30 percent to 80 percent less than brand-name products.

  • Patents expiring on about 10 widely used medications, resulting in a flood of low-priced, look-alike competitors.

  • Large retail chains’ high-visibility “$4 generic drug” discount programs that cut costs among lower-priced products.

  • Slower growth in prescription drug prices, averaging just 1.4 percent in 2007, compared to 3.5 percent in 2006.

  • Medicaid savings deriving in part from states’ use of preferred drug lists, prior authorization, supplemental rebate programs and multi-state purchasing pools.

For 2009 filed or pending bills are not included.  The report generally does not include legislation regulating only pharmacists and pharmacies, prescriptive authority, use of individual products or controlled substances, nor measures solely affecting existing Medicaid plans.  For example, bills affecting only epilepsy treatment substitutions usually are not listed. Topic codes listed for individual bills identify major topics, but may not include all provisions.  Topic codes may include measures that would restrict, as well as expand, use of a particular policy.
