Permits the court to redact and file separately on a sensitive data sheet the social security numbers from the following documents: 1) Petitions and any accompanying documents seeking to establish a support order, 2 )petitions to establish paternity and maternity, 3) petitions to register or modify a support order of another state, 4) support orders from another state, and 5) income withholding orders from another state. Requires orders of assignment to include the social security number of the obligor. Requires individuals who submit voluntary acknowledgements of paternity at the court to redact the Social Security numbers and file them separately on a sensitive data sheet. Clarifies that parties are responsible for filing SSNs on a sensitive data form and that the courts are liable for filing the information with the state case registry. Makes technical and conforming changes.

Directs the county recorder in a county with a population of more than 800,000, before January 2, 2009, to redact references to Social Security numbers (SSNs) that are recorded after December 31, 1985, and on the recorder’s Web site. Allows the county recorder to use monies in the Document Storage and Retrieval Conversion and Maintenance Fund to redact SSNs. Allows the county recorder to retain SSNs on instruments that are not available on the Web site. Requires the county recorder in a county with a population of less than 800,000 to redact references to SSNs recorded prior to January 1, 1986, and available on the Web site, upon request of the holder of the SSN. Exempts the county recorder from liability for any errors or cases of stolen identity resulting from redacting the specified records. Prohibits the use of a defendant’s SSN on an eviction judgment if his/her SSN is included in the complaint. Prohibits the Department of Revenue from imprinting the full SSN or other taxpayer identification on a tax refund check, voucher or other credit documentation issued to a taxpayer.

California

Existing law, subject to certain exceptions, prohibits a provider under the Medi-Cal program from submitting a reimbursement request to the Medi-Cal program that contains a beneficiary's Social Security number in order to receive payment if the department has issued that beneficiary a Medi-Cal beneficiary identification card containing a beneficiary number that includes the issuance date. This bill deletes the limitation on this prohibition to those instances in which the request is submitted in order to receive payment, but would exempt the submission of a request by a provider for beneficiary eligibility from the prohibition.

Requires the Office of Privacy Protection in the Department of Consumer Affairs to establish a task force, with specified members, to conduct a review of the use by all public and private colleges and universities in this state of Social Security numbers in order to recommend practices to minimize the collection, use, storage, and retention of Social Security numbers. Requires the task force to commence meetings no later than May 1, 2008, and, on or before July 1, 2010, to submit a report of its findings and recommendations to the Office of Privacy Protection and to the Assembly Committee on Judiciary and the Senate Committee on Judiciary. Declares the intent of the Legislature that, in order to protect against the risk of identity theft, local agencies shall redact Social Security numbers from records before disclosing them to the public pursuant to this chapter. This bill also provides that, unless required to do so by state or federal law, no person, entity, or government agency shall present for recording or filing with a county recorder if it displays more than the last four digits of a Social Security number, as specified. Provides that, notwithstanding any other provision of law, unless prohibited by federal law, the board shall truncate Social Security numbers on lien abstracts and any other records created by the board that are disclosable under the California Public Records Act before disclosing the record to the public. Applies requirements to redact Social Security numbers on specified filings. Requires that for every filing containing an untruncated Social Security number filed before August 1, 2007, or after that date if filed by means other than the filing office's Web site, a filing office shall create a public filing, defined to mean an exact copy of the official filing except that the first five digits of any Social Security number are redacted. Requires each filing office to post a notice on its Web site informing filers not to include Social Security numbers in any portion of their filings. Requires that, when a public filing version of an official filing exists, and upon a request for inspection, copying, or any other public disclosure of an official filing that is not exempt from disclosure, a filing office shall make available only the public filing version of that filing. Specifies that these provisions shall not apply to a county recorder. Requires the secretary of state to produce and make available financing statements that do not provide a space for the disclosure of a Social Security number of an individual. Requires the recorder of each county to establish a Social Security number truncation program in order to create a "public record" version of each "official record" so that the "public record" is in an electronic format and is an exact copy of the "official record" except that any Social Security number contained in the "official record" shall be truncated by redacting the first five digits of that number. These provisions would apply to any document recorded since January 1, 1980, as specified. Provides that when a "public record" version of an "official record" exists, and upon request of any person to inspect, for a copy of, or to otherwise publicly disclose that record, the recorder shall make available only the "public record" version of that record, and publicly disclose the "official record" only in response to a subpoena or court order. authorize a county recorder, upon authorization of the board of supervisors, to charge an additional fee of $1 for recording the first page of each document, until December 31, 2017, to be used only by the county recorder collecting the fee to implement a Social Security number truncation program pursuant to these provisions. Provides that a board shall not authorize this fee unless the board requires the county auditor to audit the county's use of funds generated by this fee, as specified, and authorizes the county recorder to request an extension of the authorization to charge this fee beyond December 31, 2017. Requires each county recorder, no later than June 1, 2008, to petition the board of supervisors for the authority to levy the fee. Provides that, notwithstanding these provisions, a county recorder shall be required to create a public record version of an official record only for that fraction of the official records for which the fee is sufficient to create a public record version. Requires that the County Recorders Association of California, no later than January 1, 2009, and annually thereafter, submit to the Assembly Committee on Judiciary, Senate Committee on Judiciary, and the Office of Privacy Protection a report on the progress each county recorder has made in complying with these provisions. Requires the Office of Privacy Protection, on or before January 1, 2018, to report to these committees on whether counties need to continue to levy the fee authorized by these provisions.

Existing law requires an abstract of judgment or decree requiring the payment of money to contain, among other things, the Social Security number and driver's license number of the judgment debtor if they are known to the judgment creditor, as specified. Property tax law authorizes a county tax collector to file specified liens on unsecured property for delinquent taxes, which filing for record without fee may contain the assessee's Social Security number, if known. This bill deletes the requirement that the above-described abstracts and filings contain the Social Security number of the judgment debtor or assessee, and instead requires only the last four digits of that person's Social Security number.

The bill also eliminates the requirements for signatures on farm product financing statements and amendments, which facilitates electronic filing of these documents with the secretary of state.

Requires the Task Force to explore the technical and procedural changes that are needed in order to implement a unique identification number system to replace the use of Social Security numbers by state and local government agencies. Requires the Task Force to report to the governor, the attorney general, the secretary of state, and the General Assembly by December 31 of each year (now March 1, 2006). Increases the membership of the Task Force and provides that the member appointed by the attorney general shall serve as chairperson of the Task Force.

Allows a state agency to disclose a Social Security number of an individual to: (1) a person that a state, local, or federal agency has contracted with to perform the duties and responsibilities of the state, local, or federal agency; or (2) a person that the state agency has entered into a contract with if the disclosure is necessary to perform the contract and the contract contains adequate safeguards against disclosure. Allows an individual to provide consent to a state agency to release the individual's Social Security number: (1) by electronic transmission; and (2) by providing the consent to a person other than the state agency if the consent expressly authorizes the state agency to release the Social Security number. Allows a state agency to release an individual's Social Security number to a private attorney if: (1) the state agency has contracted the attorney creating an attorney-client relationship with the state agency; and (2) the disclosure is necessary for the private attorney to provide legal representation to the state agency. Specifies hat the statement on a recorded instrument regarding redaction of Social Security numbers must be located at the conclusion of the instrument and below the name of the person who prepared the instrument.

The bill authorizes disclosure of registry, certificate, or record information to a person who, under a contract with a governmental entity, provides animal control services or animal registration services for that entity, provided that confidentiality is maintained. The bill provides that the information contained in a registry, certificate, or record may not include the Social Security number or the driver's license number of the animal owner.

Amends the Government Code to specify that a Social Security number maintained by a governmental entity is not confidential and to authorize a county or district clerk to disclose public information containing a Social Security number during the ordinary course of business without subjecting the clerk to civil or criminal liabilities. The bill further allows an individual to submit a written request to redact a portion of the individual's Social Security number on any information maintained by the clerk that is not required by law to maintain the entire number, and it requires the clerk to comply with this request within a reasonable amount of time. The bill also amends the Property Code to specify that a property deed is not required to contain an individual's Social Security number and to prohibit the preparer of a property deed from including an individual's Social Security number in a document that is recorded in the office of the county clerk. Finally, the bill specifies that a county clerk is not obligated to ensure that a deed presented for recording does not contain an individual's Social Security number.

Amends the Civil Practice and Remedies Code to require each party or the party's attorney in a civil action in a district, county, or statutory county court to include in the initial pleading the last three numbers of the party's driver's license number and the last three numbers of the party's Social Security number, if available. The bill allows the court to order that an initial pleading be amended to include the identifying information and to find a party in contempt if the party does not amend the pleading as ordered by the court. Amends the Property Code to require, among other provisions, that an abstract judgment show the last three numbers of the defendant's driver's license and Social Security number, if available.

Provides that the Freedom of Information Act does not apply to land records available via secure remote access. The bill provides requirements for posting land records via secure remote access to the Internet and requires, beginning July 1, 2010, that Social Security numbers not be contained in such documents. Judgments, however, will contain the last four digits of a Social Security number for identification purposes. The clerk is given the authority to reject documents that contain Social Security numbers and also is allowed to perform a global redaction of Social Security numbers from those documents filed before the 2010 deadline. The bill also allows the use of the Technology Trust Fund to pay for redaction. The bill clarifies that the clerk is to charge $0.50 per electronic image for transmitting "papers or records" to go out of his office in the same manner that he charges $0.50 per page for copying.

Authorizes the State Board of Elections to furnish voter lists to other states with protections for privacy of voter Social Security numbers. Authorizes cancellation of voter registration based on information from registration officials of other states. Makes conforming changes to sections referring to Social Security numbers to prohibit disclosure of parts of numbers. Requires the State Board of Elections to (i) approve security procedures for transmitting voter lists to other states' Chief Election Officers, and (ii) monitor implementation with annual statistical reporting to the General Assembly starting July 1, 2008.

Provides that no person filing a withholding tax return for an organization, through use of an electronic medium, would be required to provide his Social Security number for such purposes. However, such person would be required to provide his name, Social Security number, wages, and taxes withheld in any file or batch report that includes the same information for all employees of the organization.

Authorizes private attorneys and collection agencies, pursuant to an agreement with the Commonwealth, to be given access to a defendant's Social Security number to assist in the collection effort of unpaid fines, costs, forfeitures, and penalties. Also subjects such private attorneys to the identity theft provisions in §18.2-186.3.
